Privacy Policy

1. Data Controller

SynterionWorks, located at Calle Guadalajara 30, Planta Baja E, Brea de Tajo, Madrid, Spain, is the data controller responsible for the processing of personal data collected through this website in accordance with Regulation (EU) 2016/679 (General Data Protection Regulation — GDPR) and the Spanish Organic Law 3/2018 on the Protection of Personal Data (LOPDGDD).

2. Data We Collect

We collect the following categories of personal data when you interact with our services:

  • Contact Data: Name, email address, and phone number submitted through our contact form or during service negotiations.
  • Communication Data: Any messages, project briefs, or correspondence you send to SynterionWorks via email, contact form, or other communication channels.
  • Technical Data: IP address, browser type and version, operating system, referring URLs, and page interaction data collected automatically through server logs and analytics tools.
  • Payment Data: Transaction identifiers and payment confirmation details processed through third-party payment providers. SynterionWorks does not store full credit card numbers or payment credentials on its own servers.

3. Legal Basis for Processing

SynterionWorks processes your personal data under the following legal bases as defined in Article 6(1) of the GDPR:

  • Consent (Article 6(1)(a)): When you voluntarily submit information through our contact form or subscribe to communications.
  • Contract Performance (Article 6(1)(b)): When processing is necessary for the performance of a contract to which you are a party, or to take pre-contractual steps at your request.
  • Legitimate Interest (Article 6(1)(f)): When processing is necessary for our legitimate interests, such as improving our services, preventing fraud, and ensuring network security, provided these interests are not overridden by your fundamental rights.
  • Legal Obligation (Article 6(1)(c)): When we are required to process data to comply with applicable Spanish and EU law, including tax regulations and anti-money laundering requirements.

4. Purpose of Data Processing

Your personal data is processed for the following purposes:

  • Responding to your inquiries and providing requested information about SynterionWorks services.
  • Preparing project proposals, negotiating contracts, and delivering agreed-upon web engineering services.
  • Sending transactional communications related to ongoing projects, invoices, and service updates.
  • Complying with legal and regulatory obligations applicable to commercial operations in Spain and the European Union.
  • Analyzing website usage to improve performance, user experience, and service quality.
  • Preventing fraudulent activity and protecting the security of our systems and infrastructure.

5. Data Retention

SynterionWorks retains personal data only for as long as necessary to fulfill the purposes for which it was collected. Contact form submissions and related correspondence are retained for a maximum of 24 months from the last interaction, unless a contractual relationship is established, in which case data is retained for the duration of the contractual relationship and up to 6 years thereafter to comply with Spanish commercial and tax record-keeping obligations. Technical logs are retained for a maximum of 12 months.

6. Data Sharing and Third Parties

SynterionWorks may share your personal data with the following categories of third-party processors, strictly under written data processing agreements in compliance with Article 28 GDPR:

  • Hosting Providers: Server infrastructure providers that store website data and communications on secure, encrypted infrastructure within the European Economic Area.
  • Payment Processors: Third-party payment platforms that handle transaction processing. These providers are PCI-DSS compliant and do not share card data with SynterionWorks.
  • Analytics Services: Web analytics providers that process anonymized technical data to help us improve website performance and user experience.
  • Legal and Tax Advisors: Professional advisors who may access data as necessary to provide legal, accounting, or tax compliance services.

We do not sell, rent, or commercially distribute your personal data to any third party for marketing purposes.

7. International Data Transfers

SynterionWorks primarily processes data within the European Economic Area (EEA). Where data transfers occur outside the EEA, we ensure adequate protection through EU Standard Contractual Clauses (SCCs), adequacy decisions, or other safeguards recognized under Article 46 of the GDPR. 8. Your Rights

Under the GDPR and LOPDGDD, you have the following rights with respect to your personal data:

  • Right of Access (Article 15): The right to obtain confirmation as to whether personal data is being processed and to receive a copy of that data.
  • Right to Rectification (Article 16): The right to request correction of inaccurate or incomplete personal data.
  • Right to Erasure (Article 17): The right to request deletion of personal data where there is no compelling reason for continued processing.
  • Right to Restriction (Article 18): The right to request limitation of processing in certain circumstances.
  • Right to Data Portability (Article 20): The right to receive your personal data in a structured, commonly used, machine-readable format.

Refund Policy

1. Scope

This Refund Policy applies to all digital services, web engineering projects, automation deployments, and consulting engagements provided by SynterionWorks, operating from Calle Guadalajara 30, Planta Baja E, Brea de Tajo, Madrid, Spain. This policy is governed by Spanish consumer protection law (Real Decreto Legislativo 1/2007) and applicable EU directives on distance selling.

2. Pre-Project Deposits

All projects require a non-refundable deposit of 30% of the agreed project value to commence work. This deposit covers initial scoping, architecture design, and resource allocation. The deposit is payable via the payment link provided by SynterionWorks and is non-refundable once work has commenced, as defined by the delivery of the first project milestone.

3. Milestone-Based Payments

Projects exceeding 2,000€ in total value are structured around defined milestones with corresponding payment installments. Each milestone payment becomes due upon delivery and client approval of the corresponding deliverable. Payments for approved and delivered milestones are non-refundable.

4. Right of Withdrawal

In accordance with EU Directive 2011/83/EU on consumer rights, you have the right to withdraw from a distance contract within 14 days of contract formation without providing any reason, provided that work has not yet commenced. To exercise this right, you must notify SynterionWorks in writing at [email protected]. Upon valid withdrawal, any payments made (excluding the non-refundable deposit where applicable) will be refunded within 14 days using the same payment method.

Exception: The right of withdrawal does not apply once SynterionWorks has begun delivering services with your express consent and acknowledgment that this waives the right of withdrawal, or when the service has been fully performed.

5. Cancellation by Client

If you wish to cancel a project after work has commenced:

  • Cancelation before the first milestone deliverable: 30% deposit is retained by SynterionWorks. No additional charges apply.
  • Cancelation after the first milestone: All work completed up to the date of cancellation is invoiced at the agreed hourly or milestone rate. Any overpayment will be refunded within 14 days.
  • Cancelation after 75% of project completion: Full project value is due and payable.

6. Defective Deliverables

If a delivered service or project component fails to meet the specifications agreed upon in the signed project brief, SynterionWorks will rectify the defect at no additional charge within a reasonable timeframe (not exceeding 30 days from notification). If rectification is not possible, a proportional refund will be issued based on the nature and extent of the deficiency.

7. Refund Processing

All approved refunds are processed within 14 business days of approval. Refunds are issued using the original payment method. SynterionWorks is not responsible for any bank fees, currency conversion charges, or payment processing fees incurred during the refund transaction.

Terms of Service

1. Acceptance of Terms

By accessing or using the services provided by SynterionWorks ("the Company"), located at Calle Guadalajara 30, Planta Baja E, Brea de Tajo, Madrid, Spain, you ("the Client") agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and SynterionWorks. If you do not agree to these terms, you must not use our services.

2. Scope of Services

SynterionWorks provides web engineering, custom automation development, server infrastructure, and related digital services as described in individual project proposals and statements of work. The specific scope, deliverables, timelines, and pricing for each engagement are defined in a separate written agreement or project brief signed by both parties.

3. Project Engagement Process

  • Initial Consultation: SynterionWorks provides a free initial consultation to understand your requirements and assess project feasibility.
  • Proposal and Quote: Following consultation, SynterionWorks delivers a detailed proposal including scope, timeline, and pricing.
  • Acceptance and Deposit: Work commences upon written acceptance of the proposal and receipt of the required deposit.
  • Development and Delivery: Project deliverables are produced according to the agreed timeline and milestone schedule.
  • Review and Approval: Each deliverable is subject to client review. Approval must be provided within 7 business days of delivery. Failure to respond constitutes automatic approval.

4. Client Obligations

The Client agrees to:

  • Provide timely access to all necessary systems, credentials, content, and information required for project completion.
  • Designate a single point of contact authorized to provide approvals and feedback on behalf of the Client.
  • Respond to queries and feedback requests within 5 business days to prevent project timeline delays.
  • Ensure that all content provided to SynterionWorks does not infringe upon any third-party intellectual property rights.

5. Intellectual Property

Upon receipt of full payment for a completed project, the Client receives full ownership of all custom-developed code, designs, and deliverables produced specifically for the Client under that project. SynterionWorks retains ownership of all pre-existing tools, frameworks, libraries, and methodologies used in the development process. SynterionWorks reserves the right to display the completed project in its portfolio and marketing materials unless otherwise agreed in writing.

6. Confidentiality

Both parties agree to maintain the confidentiality of all proprietary information exchanged during the course of the engagement. This obligation survives the termination of the agreement for a period of 3 years. Confidential information includes but is not limited to business strategies, technical specifications, source code, customer data, and financial information.

7. Limitation of Liability

SynterionWorks shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our services. Our total liability for any claim arising from or related to our services shall not exceed the total amount paid by the Client to SynterionWorks for the specific project giving rise to the claim. SynterionWorks is not liable for delays or failures in performance resulting from causes beyond its reasonable control, including but not limited to natural disasters, government actions, internet service disruptions, or force majeure events.

8. Warranty

SynterionWorks provides a 90-day warranty on all delivered project components, commencing from the date of final project approval. During this warranty period, SynterionWorks will correct any defects in functionality that deviate from the agreed project specifications at no additional charge. This warranty does not cover issues arising from unauthorized modifications, third-party integrations, hosting environment changes, or usage outside intended parameters.

9. Termination

Either party may terminate this agreement with 14 days written notice. In the event of termination:

  • The Client is responsible for payment of all work completed up to the date of termination.
  • SynterionWorks will deliver all completed work products to the Client within 10 business days of termination.
  • Provisions relating to confidentiality, intellectual property, and limitation of liability survive termination.

10. Governing Law and Dispute Resolution

These Terms of Service are governed by the laws of Spain and the European Union. Any disputes arising from or relating to these terms or the services provided by SynterionWorks shall first be resolved through good-faith negotiation. If negotiation fails within 30 days, disputes shall be submitted to the competent courts of Madrid, Spain. The Client also retains the right to use the EU Online Dispute Resolution platform at https://ec.europa.eu/odr.

11. Amendments

SynterionWorks reserves the right to amend these Terms of Service at any time. Material changes will be communicated to existing Clients via email at least 15 days before taking effect. Continued use of our services after the effective date of any changes constitutes acceptance of the amended terms.
